Agtran Travel Sdn. Bhd., sometimes known as "Agtran, Agtran Rent a Car" ("we", "us", and "we"), is a Malaysian corporation that runs the www.agtran.com website (the "Website"). These terms and conditions, along with our privacy notice and cookie statement, are the entirety of our agreement with you for the vehicle rental services we provide.
Please note that we reserve the right to change, modify, add, or delete portions of these Terms at any time if doing so is necessary to comply with any applicable law or regulation or to reflect a change in our operational practises, provided that we will use reasonable efforts to provide notice of material changes on the Site. Check these Terms each time you visit the Site to ensure you've read the most recent version. By continuing to use any portion of the Site after these Terms have been modified, you agree and consent to these modifications and their application to you.
Any reservation made on this website by you, the renter, is contingent upon your acceptance of our Terms. If you do not agree with any portion of our Terms, you must cancel your reservation. By making a reservation on this website, you imply or confirm that you have read and agree the relevant Terms.
In the majority of Malaysia localities, the minimum age for renter is 21. For drivers under the age of 21 or over the age of 65, additional fees may apply for some vehicles and in certain countries; if the right driver age has been provided with the booking request, we will inform you of any potential expenses. Minimum age restrictions for larger vehicles may also be greater. Please contact our Customer Service with any questions or concerns regarding this topic.
The pricing of your vehicle's rental will be confirmed and computed based on 24-hour increments at the time of booking. If you wish to extend the period of hire after picking up the car or if you return the car later than stated on your booking, the contract for such an extension will always be with the car hire company directly, and the extra time will be charged at the local daily rate, which may be higher than the rates agreed with us at the time of booking. Agtran Rent a Car may additionally assess an additional fee for late return; the terms of such additional fees will be outlined in the rental agreement.
This will be validated throughout the booking process. All drivers must possess a valid, full Malaysia licence that they have held for at least 2 years. Invalid or temporary licences will not be accepted. Customer Service must be informed of any endorsements or points on a driver's licence at the time of booking; we reserve the right to refuse the reservation based on the terms & conditions of the car rental businesses we work with. At the time of vehicle pickup, each driver must produce their driver's licence. In addition, they must carry their driver's licence with them at all times for inspection by local authorities.
If Agtran Rent a Car declines to offer a vehicle due to undeclared endorsements, or if you are unable to present a driving licence, its counterpart, or the necessary information regarding endorsements, there will be no refunds given.
Please be aware that an International Driving Permit (IDP) can be necessary when driving abroad. The driver is in charge of determining whether they require an International Driving Permit (IDP). A full driving licence in the name of the primary driver will still be necessary in order to rent a vehicle, and any driver who needs an International Driving Permit (IDP) must always carry both documents with them. An International Driving Permit (IDP) does not substitute a regular driving licence. Without the permit and your driver's licence, you won't be able to pick up your rental if an International Driving Permit (IDP) is necessary.
Before picking up their vehicle, all drivers must understand the terms and conditions of the automobile rental firm because some businesses and places could have extra restrictions.
Cases in which a customer or renter fails to pick up the car after reserving it are referred to as "No Show" situations, which entail no refund or return of money paid when reserving the vehicle.
During the rental time, Agtran Rent a Car reserves the right to replace the vehicle rented by the customer due to a puspakom inspection, damage, repair, etc. By consenting to the terms and conditions, the renter consents to Agtran Rent a Car's complete authority to swap the vehicle during the rental period.
When we are unable to lend a rent-a-vehicle of the class selected by the renter due to maintenance, breakdown, etc., we can offer to rent another class of car. When the Renter accepts the offer outlined in the preceding paragraph, we shall provide an alternate automobile rental with the same terms as the original reservation, excluding the car class. In addition, when the rental charge of the substitute car is less than the rental fee of the booked car class, the rental fee is based on the rental fee of the substitute rental car's car class. The renter will receive a refund and will only be charged for the vehicle class that was substituted.
Self-pickup and delivery are the accessible collection options. To request delivery, simply request it directly with us during car reservation along with the delivery address. For deliveries, we will still need to collect and return the vehicle to our storage facility during business hours, thus an additional fee will be added to the customer's account. If you have requested delivery outside of our operation hours, a service fee of RM 20.00 per half-hour will be collected at the time of your appointment, subject to approval. There is no delivery fee for deliveries made during business hours.
Agtran Rent a Car will, at its own expense, perform routine maintenance as advised or required by the vehicle's manufacturer or distributor, associated with normal wear and tear, and/or repair any defect or breakdown that, in the owner's opinion, is not the result of the renter's negligence, act, omission, or failure.
All maintenance and repairs must be done in the workshop that Agtran Rent a Car may have approved or specified. The renter shall not authorise any maintenance or repair work on the Vehicle to be performed by or at any other workshop than the approved workshop. The Renter is responsible for transporting the Vehicle to an Agtran Rent a Car-approved location.
If the Unavailability Period for any Maintenance and Repair that the Owner is obligated to perform due to:
If it exceeds 8 hours but is less than 12 hours, the Rental Fee must be decreased by an amount equal to the Rental Fee for a half-day of rental during the Unavailability Period.
exceeds 12 hours, the Rental Fee for the Unavailability Period must be decreased by an amount equivalent to the Rental Fee for the actual number of days (rounded to the nearest half day) comprising the Unavailability Period.
During breakdown or maintenance, Agtran Rent a Car shall not be liable for any loss sustained or incurred by the renter as a result, including income loss.
The Renter and the Driver shall not engage in the following acts during the rental period:
Using the Rental Car for the purpose of vehicle transportation business or for other similar purposes, without obtaining the consent of Agtran Rent a Car and the permit required by the Road Transportation Act.
Allowing the use of or sub-renting the Rental Car to a party other than the Driver stated in the rental certificate.
Counterfeiting or defacing the Rental Car's registration number plate or licence plate or changing the original state of the Rental Car such as modifying or remodelling the Rental Car.
Using the Rental Car in any kind of test or competition or using it to tow or support other vehicles without obtaining the consent of the Company.
Using the Rental Car in violation of laws and regulations, or public order and morals.
Enrolling in an insurance against loss for the Rental Car without obtaining the consent of Agtran Rent a Car.
Taking the Rental Car out of Malaysia
Illegally parking the Rental Car
Engaging in acts that cause significant trouble to the Company or other renters, such as smoking inside the Rental Car, leaving items in the Rental Car, and defacing the Rental Car.
When a pet has been carried in the vehicle without the Agtran Rent a Car permission.
When kerosene, gasoline, or other hazardous materials, or articles that could be dangerous or harmful to the health of the Company or other users, such as radioactive materials or infectious disease samples, have been loaded onto the vehicle without permission.
Child seats, roof racks (not available on some vehicles), and other "extras" are available upon request in the majority of locations, but cannot be guaranteed. Typically, a fee is charged by us. In the majority of locations, kid safety seats are required by law. Please be aware that rear seatbelts may not be available in all vehicles. Please contact our Customer Service for more information on these things. These products must be requested at the time of booking.
Your rental period begins and ends on the dates and at the times specified in your reservation. Unfortunately, we cannot issue refunds for unused time if a vehicle is returned early or picked up late. If you cannot pick up the vehicle at the agreed upon time and day, you must inform us immediately. If you fail to do so, there is no assurance that the car will still be available, and you will not be eligible for a refund.
All cars are insured for a maximum number of occupants. We cannot be held liable if the vehicle cannot accommodate all passengers and luggage. Please consult the website agtran.com for approximate capacity of the various car classes. We cannot be held liable if the car rental operator refuses to provide a vehicle because your group is too large.
Sometimes, we may offer reduced rates or promotions. Please note that these booking and refund policies may be subject to varying circumstances and criteria.
If you intend to drive from one country/state to another, you must inform us at the time of booking, as each country/state crossing has its own criteria and limits. There may be additional fees and documentation requirements when travelling to some countries. However please do not hesitate to contact our Customer Service regarding the matter above. All rental vehicles not for use in off-roads, unsealed or unmade roads or surfaces.
The fuel policy rule suggests how much gas must be in the rental car's tank at the time of pick-up and drop-off. Fuel policies include Full to Full and Level to Level. Full to Full indicates that if you rent a car with a full tank, you must return it with a full tank. Level to Level indicates that if the car is picked up with a specific amount of fuel in the tank, it must be returned with the same amount of fuel. Otherwise, the renter will be charged according to Agtran Rent a Car's fuel rates for a refill upon return. If the renter returns the vehicle with the fuel above the defined amount, there will be no refund given. Please note that the renter has agreed to no returns by consenting to these terms and conditions.
The touch ‘n go policy rule suggest how much balance must be in the touch ‘n go provided by Agtran Rent a Car at the time of pick-up and drop-off. Touch ‘n go policies indicates that if Agtran provide the card or account of touch n’ go with a specific amount balance, the renter must return the card or account with the same amount of balance during drop-off. Otherwise, the renter will be charged according to Agtran Rent a Car’s touch ‘n go rates. If the renter returns the card above the defined amount, there will be no refund given. Please note that the renter has agreed to this touch ‘n go policy by consenting to these terms and conditions.
All materials and goods emitting offensive odours are prohibited from being transported in the vehicle (e.g., Durians, salted fish, liquor etc). The renter is responsible for reimbursing Agtran Rent a Car on demand for all costs associated with eradicating such odours, including the servicing of the entire air conditioning system and Agtran Rent a Car's loss of rental days. Please be warned that smoking is strictly prohibited in all Agtran Rent a Car vehicles.
In the event of technical issues or vehicle breakdown, you must contact Customer Support immediately. If you are involved in an accident, you must immediately call our Customer Support and the local authorities. It is recommended that you maintain all pertinent documentation, since you may be questioned for it. When submitting an insurance claim, these documentation will be necessary.
Your car rental is subject to the terms and conditions imposed by us, our terms and conditions, and the applicable laws of the country/state in which the rental takes place. agtran.com does not accept responsibility for and should not be held liable for any damage, delays, loss, changes or alterations resulting from industrial dispute including air traffic control disagreements, civil strife, unavoidable technical problems with transport, terrorist activity, fire or adverse weather conditions, airport or port closure or congestion, natural and nuclear disaster, financial failure of airlines, or cancellation of scheduled airlines.
During the duration of the rental, the renter is responsible for all parking, speeding, and traffic violations as well as tolls incurred in connection with the car. In addition to the toll price, Agtran Rent a Car will assess an administration fee if it receives an Unpaid Toll Notice pertaining to the period the vehicle was rented. If Agtran Rent a Car receives notice of a speeding, parking, or other traffic violation during the period the vehicle was rented, Agtran Rent a Car will file a statutory declaration identifying the renter as the car's driver and impose an administration fee of any traffic violation.
There are no designated smoking cars. If you break the policy, Agtran Rent a Car may impose additional cleaning fees to remove odours and stains caused by smoking.
To guarantee that no alterations are made to the vehicle or any removed parts, the company reserves the legal right to investigate any modification or disassembly of the rental vehicle or its parts.
In the event of a punctured tyre or collision with certain hard objects while driving, the renter is responsible for replacing the tyre. If the tyre becomes naturally punctured while driving, it must be evaluated at a nearby tyre repair shop. Every car has an extra tyre. If there is a flat, the renter is responsible for changing the tires themselves. The Customer Service hotline solely provides information on a car engine failure or accident.
Highway - 70 km/h to 110 km/h
Country road - 50 km/h to 90 km/h
Rainfall is abundant in Malaysia. On days with precipitation, renters are required to travel cautiously. Generally, the highways are driven from 50 km to 90 km on rainy days and from 30 km to 70 km on rural roads.
In our experience, our renters drive cautiously, and accidents are uncommon. Therefore, instances of car damage are the exception rather than the norm. However, it is essential to comprehend how we will handle the damage if it occurs.
If you discover some damage to the vehicle, you can report it by contacting Customer Service. Agtran Rent a Car will then send you a bill detailing the repair expenses in addition to an administration fee for the handling of the Damage and Vehicle immobilisation, which will be billed to you.
Costs vary based on the nature of the damage:
Light damage, insubstantial damage that does not impair the vehicle's safe operation, such as scratches; light hits on glass, bumper scratches: According to the Agtran Rent a Car recommended price list, fees are assessed.
Significant damage that impairs the vehicle's function and necessitates its temporary immobilisation, such as bodywork damage. This type of damage will be assessed by an independent expert and charged according to the expert's report or an independent vehicle repair shop's cost estimate.
Upon your departure, Agtran Rent a Car will provide you the following documentation if a member of its staff or a representative discovers any damage to the rented vehicle during a post-rental inspection.
Statement of return of the Vehicle detailing all identified damages
Photographs of Damage
An estimate of the repair costs, which will vary based on the type of damage, plus an administration fee for the treatment of the damage and the immobilisation of the vehicle.
If you desire to contest the damage noted or the cost of repair, please contact us through Customer Service or writing within fourteen days after receiving the documentation. At the conclusion of this 14-day period, Agtran Rent a Car may send you an invoice for the cost of repairs and administrative fee.
Agtran Rent a Car is not responsible for pursuing any claims the renter may have against third parties for any damage or loss, including any liability paid to us by the renter. Agtran Rent a Car will issue an invoice for all amounts paid by the renter. If the renter arranges alternative insurance coverage for the renter's liability or any other payment due under the provisions of this agreement, the renter will pay the full amount directly to Agtran Rent a Car. It is not the Agtran Rent a Car responsibility to supply the renter or any other party with alternative repair estimates, police reports, photographs, or any other material required to support the renter’s later insurance claim.
Bookings cancelled 48 hours before the start of the rental date will receive a full refund.
Due to Cov-19 which is affecting the world, people who are infected with cov-19 can apply to change the date up to 3 months ahead. However there are conditions users must follow:
Users need to provide a document which is proving he/she was affected by covid at the certain date.
Contact the customer service or notify us before the rental starts.
Cancellations made less than 48 hours before the start of the rental without solid reason.
Cancellations made to downgrade vehicles less than 48 hours before the start of the rental.
Failure to provide the actual driver as registered on the form to collect the car at the specified date & time.
Vehicle cannot be picked up or failure to collect the car at the specified date & time.
Failure to present a valid driver's licence or International Driving Permit (IDP) during pick-up.
Some refunds may need a support document before the refund process is made. However all the refunds will be made depending on the situation and approved by management. Please do not hesitate to contact customer service for any matters. Payment will be credited within approximately 14 business days.
All quotations, invoices, booking confirmations, and receipts are generated digitally and sent. The final receipt is available upon request and will be emailed after the rental items have been returned. A rental agreement will need to be signed at the time of pickup (collection) or return (delivery). Before filling in all the essential information and signing the agreement, we recommend that all customers or their authorised representatives read it carefully. For verification purposes, the customer or salesperson must produce their identification card and driver's licence. Failure to do so will result in Agtran Rent a Car refusing to release the rental to the customer or agent, and no refunds will be granted for the complete rental amount.
Agtran Rent a Car has the right to terminate the renter account and the vehicle may be taken back at any time, at our sole discretion, if it is discovered to be illegally parked, being used to break the law or the conditions of the rental agreement or appearing to be abandoned. You acknowledge that we may take whatever steps are deemed reasonably required to take control of the car without giving you prior notice. You consent to paying or compensating us for the actual and reasonable costs spent by us to repossess the vehicle if it is repossessed. You agree that such costs will be charged to the account you used to rent the car.
The owner needs the information from the renter to evaluate the renter's request to rent a car. Although the renter is not required to provide this information, the owner cannot lease the car if the renter does not. The renter understands that the owner will gather, store, and use personal information about the renter in connection with the rental of the vehicle and the provision of related customer services, including direct marketing and gauging customer satisfaction with the owner's goods and services. The renter hereby authorises the disclosure of their personal information for such purposes and further acknowledges that such personal information may be disclosed to debt collection agencies if the renter defaults in the payment of any money owed to the owner, or to other parties involved in an accident with the vehicle while on hire to the renter, or to any organisations responsible for the processing or handling of traffic related infractions.

Malaysian law is applied to this agreement. Any matter may be brought before Malaysian courts for resolution. The remaining provisions of this Agreement shall not be affected if any provision is or becomes invalid or unenforceable.
The rental vehicle is the property of Agtran rent a car. this agreement pertains solely to the use of the vehicle. during the period in which the vehicle is rented to the renter. the renter is not agtran rent a car's agent for any reason, capacity, or representation; consequently, Agtran Rent a Car's prior consent is required for any service to or replacement of a part of accessory in the vehicle during the rental period. the only right acquired by the renter is the right to use the vehicle in line with the terms of the rental agreement. The owner makes no expressed or implied warranty of any kind, in any nature or description, as to the merchantability or fitness for any particular purpose of any vehicle covered by this agreement. The renter shall not make any claim against Agtran Rent a Car for damages for delays caused by a breakdown or accident involving the vehicle, and shall indemnify agtran rent a car for any damages payable by the Agtran as a result of such claims.
